These Terms of Service (“Terms”) govern your use of the Blue Collar Workflows website, platform, and related services (collectively, the “Service”). The Service is provided by Blue Collar Workflows LLC (“Blue Collar Workflows,” “BCW,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms.

1. Agreement and Business Use
The Service is intended solely for business and commercial use. It is not intended for personal, family, or household use. By using the Service, you represent that you use it for a legitimate commercial purpose. If you use the Service for a company or other organization, you represent that you have authority to accept these Terms for that organization. In that case, “you” and “your” include that organization and its authorized users.
These Terms are a binding agreement between you and Blue Collar Workflows LLC. If you do not agree to them, do not use the Service.
2. The Service
BCW provides software and automation tools designed to help service businesses manage operational workflows. Features may include customer and job management, quotes and estimates, invoices, scheduling, document generation, customer communications, payment-related integrations, AI-assisted workflows, and other features we make available.
We may change, improve, add, suspend, or discontinue features when reasonably necessary. We do not promise that every feature will be available at all times, in every location, or for every type of business. Nothing in the Service makes BCW the contractor or service provider for work you perform for your customers.
3. Accounts and Authorized Users
You must provide accurate account information and keep it reasonably current. You are responsible for protecting your account credentials and for activity that occurs through your account. Do not share credentials except as permitted through the Service’s account and user-management features.
You are responsible for deciding who may access your account or workspace (“Authorized Users”), controlling their access, and ensuring they comply with these Terms. You must promptly notify us at the contact address below if you suspect unauthorized access to your account. We may reasonably rely on instructions and activity associated with your account.
4. Customer Content and Privacy
“Customer Content” means information or materials you or your Authorized Users submit to, store in, connect to, or generate through the Service, including business and customer information, job information, estimates, photographs, documents, pricing, communications, and related content. As between you and BCW, you retain ownership of your Customer Content. BCW does not claim ownership of it.
You are responsible for Customer Content and represent that you have the rights, permissions, notices, and consents needed to provide it to BCW and allow us to process it as these Terms describe. This includes responsibility for your communications with, and information about, your own customers.
You grant BCW a limited, non-exclusive right to host, store, process, transmit, reproduce, and otherwise use Customer Content only as reasonably necessary to operate, maintain, secure, support, and provide the Service and features you choose to use. We may use aggregated or de-identified information for legitimate purposes such as operating the Service, security, reliability, analytics, and product improvement, provided it does not reasonably identify you or an individual.
Our handling of personal information is also described in our Privacy Policy, which is incorporated into these Terms by reference.
5. Automated and AI-Assisted Features
The Service may include automated or AI-assisted features that help generate estimates, quotes, line items, material quantities, labor assumptions, pricing suggestions, schedules, summaries, documents, communications, or other business output. These features are tools to assist your work, not a substitute for your judgment.
Automated or AI-generated results may be inaccurate, incomplete, inappropriate, outdated, or unsuitable for a particular job. Output may appear accurate even when it is incorrect. You are responsible for reviewing and approving output before relying on it, sending it to a customer, or using it operationally.
BCW does not provide legal, accounting, tax, financial, engineering, licensed trade, or professional estimating advice or services. You should obtain advice from qualified professionals when your circumstances require it.
6. Quotes, Estimates, Invoices, and Customer Transactions
You are solely responsible for reviewing and approving all quotes, estimates, prices, measurements, quantities, materials, labor assumptions, taxes, invoices, schedules, customer communications, job requirements, and other business output created, stored, or sent through the Service. BCW does not guarantee that any quote, estimate, price, or job will be accurate, complete, or profitable.
Blue Collar Workflows is not a party to agreements, quotes, estimates, invoices, work orders, services, or other transactions between you and your customers. You remain solely responsible for your services, contractual obligations, workmanship, licensing, permits, code compliance, safety, pricing, taxes, and customer disputes. BCW provides software tools; it does not perform the underlying trade services.
You are responsible for determining, collecting, reporting, and remitting taxes applicable to your transactions with your customers. Any tax calculation, field, suggestion, or configuration in the Service is a convenience only and is not tax advice. BCW does not determine whether a particular service, trade, or transaction is taxable.
7. Third-Party Services
The Service may integrate with or depend on third-party services, including payment processors, cloud-hosting providers, AI providers, email and messaging providers, authentication providers, and other software or infrastructure providers. Your use of a third-party service may be subject to that provider’s own terms and privacy policy.
BCW is not responsible for outages, failures, acts, omissions, security incidents, or changes involving third-party services that are outside our reasonable control. This does not limit responsibility for BCW’s own conduct.
8. Subscriptions, Billing, and Cancellation
Paid subscriptions are billed on a recurring monthly basis unless we clearly state otherwise at checkout. You authorize BCW and its payment processor to charge your designated payment method for applicable subscription fees, taxes charged by BCW where applicable, and other authorized charges for each billing period until you cancel.
You may cancel your subscription before the next billing date to stop future recurring subscription charges. Cancellation does not automatically create a refund for charges already paid, and we do not promise refunds except where required by law or provided in a separate published BCW refund policy. Your access may continue through the end of the paid billing period unless we state otherwise.
We may change subscription prices on reasonable advance notice. If a payment fails, we may retry the payment, restrict features, suspend access, or cancel the subscription after reasonable efforts to notify you where practical. You are responsible for providing current, valid payment information.
9. Acceptable Use
You may use the Service only in compliance with these Terms and applicable law. You may not use the Service to violate law; commit or facilitate fraud; infringe intellectual-property, privacy, or other rights; impersonate another person or business; send unlawful communications; distribute malicious code; interfere with the Service; or abuse or exploit the Service.
You may not attempt to gain unauthorized access to the Service, another customer’s account or workspace, or related systems; bypass security controls; compromise other customers or tenants; reverse engineer, decompile, disassemble, scrape, or use automated means to extract the Service or discover source code, except to the extent a restriction is not permitted by applicable law. You may not use the Service in a way that creates unreasonable risk to BCW, our users, or the Service.
10. Intellectual Property and Feedback
Except for Customer Content, BCW and its licensors own the Service and all related software, platform architecture, designs, interfaces, branding, documentation, workflows, and proprietary materials. Subject to these Terms and payment of applicable fees, BCW grants you a limited, non-exclusive, non-transferable, non-sublicensable right to use the Service during your authorized subscription for your internal business purposes.
If you provide ideas, suggestions, recommendations, or feedback about the Service, you grant BCW the right to use that feedback without restriction or compensation. This feedback provision does not transfer ownership of Customer Content to BCW.
11. Suspension and Termination
You may terminate these Terms by canceling your subscription and stopping use of the Service. We may suspend or terminate access when reasonably necessary because of nonpayment, fraud, a security threat, illegal activity, a material violation of these Terms, abuse of the Service, or conduct creating substantial risk to BCW or other customers.
Where reasonable, we will provide notice and an opportunity to resolve an issue before termination. We may suspend access immediately for serious security, fraud, or legal concerns. Following termination, your access to the Service will end. Customer Content may be retained or deleted in accordance with our Privacy Policy, retention practices, and legal obligations. We do not promise a particular data-export or deletion period unless we separately state one in writing.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” BCW DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
BCW does not guarantee uninterrupted or error-free operation, particular business results, profitability, the accuracy of automated output, suitability for a particular trade or job, or continuous availability of third-party integrations. Some laws do not allow certain disclaimers, so parts of this section may not apply to you. Nothing in these Terms excludes warranties or rights that cannot legally be disclaimed.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BCW AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, LOST GOODWILL, OR LOSS OF DATA, ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS, REGARDLESS OF LEGAL THEORY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF BCW AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE FEES YOU PAID TO BCW FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnification
You will indemnify, defend, and hold harmless BCW and its owners, officers, employees, contractors, affiliates, and agents from third-party claims, damages, liabilities, costs, and reasonable attorneys’ fees arising from your Customer Content; your services or business activities; your violation of law or these Terms; your infringement or alleged infringement of a third party’s rights; or your dealings with your customers.
BCW will give you prompt notice of a claim, to the extent practicable; provide reasonable cooperation at your expense; and allow you to control the defense and settlement. You may not settle a claim in a way that imposes liability, admission, or obligation on BCW without BCW’s prior written consent, which will not be unreasonably withheld.
15. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.

16. General Terms
These Terms, together with the Privacy Policy and any order or subscription terms presented at checkout, are the entire agreement between you and BCW about the Service and replace prior agreements on that subject. If any provision is unenforceable, the remaining provisions will remain in effect. A waiver is effective only if in writing and applies only to the specific instance waived.
You may not assign or transfer these Terms without our prior written consent. BCW may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets. BCW is not liable for a delay or failure caused by events outside its reasonable control, including natural disasters, labor disputes, acts of government, war, civil unrest, internet, infrastructure, hosting, or communications failures.
We may provide notices electronically through the Service, by email, or by posting on our website. These Terms do not create a partnership, joint venture, employment, agency, fiduciary, or other relationship between you and BCW.
17. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide reasonable advance notice by email, through the Service, on our website, or by another reasonable method. We will update the “Last Updated” date when changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes acceptance where legally permitted.
